Terms of use
These terms describe the agreement between you and Thinkaholic ("we", "us") when you use the Attent mobile application and related services ("Attent").
1. Acceptance
By downloading, installing, or using Attent you agree to these terms. If you do not agree, please do not use Attent.
2. What Attent does
Attent is a relationship reminder application. It helps you:
- store contacts and important moments such as birthdays, anniversaries, memorial days, and milestones
- receive local reminder notifications on your device
- generate on-demand message suggestions for those moments
- hand off to WhatsApp or copy a message so you can send it yourself
Attent does not replace a calendar, CRM, or messaging platform. Attent does not send messages on your behalf.
3. Your account
You can use Attent anonymously. If you link a Google, Apple, or email account, the terms of that provider also apply to that sign-in. You are responsible for keeping your sign-in credentials safe. You must be at least 13 years old (or the minimum age in your jurisdiction) to use Attent.
4. Your responsibilities
- You are responsible for the contact information and notes you add to Attent, including having the right to store that information for your personal use.
- You agree not to use Attent to harass, threaten, or send unlawful content to other people.
- You agree not to interfere with Attent's functionality or attempt to access other users' data.
- You agree to follow the terms of any third-party service you use together with Attent (for example, WhatsApp, Google, or Apple).
5. Reminders and messaging
Reminders are scheduled locally on each device on which you install Attent. Delivery depends on your operating system, device state (battery, focus modes, "Do Not Disturb"), and platform notification limits. Attent makes a best effort to schedule reminders reliably but does not guarantee that any specific reminder will be delivered at a specific moment.
Attent's WhatsApp handoff opens WhatsApp with a prepared message. Whether the message is actually sent, edited, or cancelled is entirely under your control and subject to WhatsApp's own availability and terms.
6. AI suggestions
AI suggestions are provided as a helper, not as a promise of accuracy, tone, or appropriateness for any situation. Always review a suggested message before sending. You remain responsible for anything you send.
7. Intellectual property
Attent, including its branding, design, code, and documentation, is owned by Thinkaholic and its licensors and is protected by applicable intellectual property laws. These terms do not grant you any rights to our trademarks or branding.
The contact information, events, and notes you enter remain yours. You grant us the limited permission required to store, process, and display that data back to you, to generate suggestions on your request, and to operate Attent's backend.
8. Fees
Attent is free to use at launch. If we introduce optional paid features in the future, the price and scope will be disclosed before you buy them and will not retroactively affect data you have already created.
9. Termination
You can stop using Attent at any time by deleting the app from your device. You can delete your account and associated data from Settings → Account. We may suspend or terminate your access to Attent if you violate these terms or use the service in a way that risks harm to others or to the platform.
10. Disclaimer and liability
Attent is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by law. We do not warrant that Attent will be uninterrupted, error-free, or that any reminder will be delivered on time.
To the maximum extent permitted by applicable law, Thinkaholic is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, relationships, or opportunities arising out of or related to your use of Attent. Nothing in these terms limits your statutory consumer rights.
11. Governing law
These terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles. Any dispute will be brought before the competent courts of that jurisdiction, except where mandatory local law gives you the right to bring the dispute elsewhere.
12. Changes to these terms
We may update these terms when Attent, its features, or the legal environment changes. Material changes will be announced in the app and reflected on this page. The effective date at the top shows the current version. Your continued use of Attent after an update means you accept the updated terms.
13. Contact
Questions about these terms can be sent to contact@thinkaholic.nl.
